  4.  IRA Qualified Charitable Distributions

The IRS reminds taxpayers that the qualified charitable distribution (QCD) provisions were renewed for 2010 and 2011, allowing IRA owners, age 70½ or over, the option of transferring tax-free up to $100,000 to qualified charities.

The excluded amount can be used to satisfy any required minimum distributions that the individual must otherwise receive from their IRAs for 2010 and 2011. The deadline for making a 2010 QCD is January 31, 2011. The election to treat a January 2011 QCD as having been made in 2010 is made by including the QCD on the individual’s 2010 income tax return.

  6.  PTINs Now Mandatory For Tax Preparers

Effective January 1, 2011, all individuals who are compensated for preparing, or assisting in the preparation of, all or substantially all of a tax return or claim for refund of tax must have a preparer tax identification number (PTIN), effective January 1, 2011.

A PTIN must be included in the paid preparer section of all returns prepared by a paid preparer, except as provided in Notice 2011-6 and other guidance. Social security numbers or other identification numbers are not acceptable.

The IRS recognizes that some tax return preparers are experiencing or may experience difficulty in obtaining a PTIN. Accordingly, the IRS has issued Notice 2011-11 which permits certain individuals who have made a good faith effort to timely obtain a PTIN, but have experienced processing problems, to prepare returns using  their prior PTIN or SSN as their preparer tax identification number during the 2011 filing season while their applications are pending. This relief only applies for the 2011 filing season.
